Malignant mesothelioma patients likely to benefit from drug pemetrexed identified, study suggests

ScienceDaily (Aug. 29, 2012) ? Previous studies have hypothesized that low levels of the enzyme thymidylate synthase (TS) likely mark patients who will benefit from the drug pemetrexed -- but results have been inconclusive at best and at times contradictory.

A University of Colorado Cancer Center study recently published in the Journal of Thoracic Oncology provides an explanation of why: only in combination with high levels of a second enzyme, FPGS, does low TS predict response to pemetrexed in patients with malignant pleural mesothelioma.

"The hope is that oncologists could test a patient for TS and FPGS levels and so discover if the patient should be treated with pemetrexed or if another therapy might be more appropriate," says the paper's first author, Daniel C. Christoph, MD, PhD, medical oncologist at the West German Cancer Center, working as an international postdoctoral researcher in the lab of CU Cancer Center investigator, Fred Hirsch, MD, PhD.

Pemetrexed works by inhibiting the enzyme TS, which cancer cells need in order to replicate their DNA. So it stands to reason that tumors already low in TS would be most affected by the drug -- blocking the remaining TS would effectively stop the ability of cancer cells to synthesize new DNA.

However, Christoph and colleagues tested 84 samples of mesothelioma in which patients had been treated with pemetrexed and found that low levels of TS only in combination with concurrently high levels of FPGS predicted patients' response to the drug.

The study also explained the mechanism by which FPGS increases the clinical effectiveness of pemetrexed: "High levels of FPGS allow pemetrexed to stay longer inside cells, giving the drug longer to work against TS," Christoph says. Of the samples tested, patients with low TS and high FPGS had more response to pemetrexed and longer durations of survival.

According to Christoph, the current study provides the preclinical work needed to justify exploring the predictive power of TS and FPGS in mesothelioma patients. A prospective observational study of these biomarkers could lead to their wide use in predicting patients' response to pemetrexed.

Ga. prosecutor seeks death penalty for 3 soldiers

LUDOWICI, Ga. (AP) ? Georgia prosecutors will seek the death penalty against three Army soldiers accused of killing a former serviceman and his girlfriend to protect an anti-government militia group, officials said Thursday during tense court hearings in which one victim's stepfather was tackled and handcuffed as he tried to rush the defense table.

Pvt. Isaac Aguigui, Pvt. Christopher Salmon and Sgt. Anthony Peden ? all active-duty soldiers stationed at Fort Stewart ? are each charged with 13 counts including malice murder, felony murder and illegal gang activity in the Dec. 4 slayings.

The victims, former soldier Michael Roark and his 17-year-old girlfriend, Tiffany York, were shot in the head in the woods of rural Long County near Fort Stewart in southeast Georgia. Fishermen found their bodies the day after they were killed.

"I want them gone. I want all of these individuals to disappear," said Nicholas Lee York, the slain girl's older brother, who applauded the decision to seek death for the soldiers. "They took something irreplaceable from me."

The case took a stunning turn at an earlier hearing Monday when prosecutors told a Superior Court judge the accused soldiers belonged to an anti-government militia operating within the U.S. military that had stockpiled at least $87,000 worth of guns and bomb components. They said the group had a range of plans ? from bombing a park fountain in nearby Savannah to poisoning apple crops in the state of Washington ? and its ultimate goal was to overthrow the U.S. government and assassinate the president. However, President Barack Obama was not mentioned by name as their target.

Atlantic Judicial Circuit District Attorney Tom Durden cites domestic terrorism as an aggravating factor that warrants the death penalty. However, all charges against the soldiers relate directly to the killings. No charges have been filed in state or federal court accusing the three suspects of terrorist plots or acts.

"Sometimes some of these things don't fit neatly into our state laws," Durden said after court when asked about the absence of terrorism-related charges. "We're going forward with what we feel comfortable with."

Because they now face capital charges, all three soldiers will need to have new attorneys appointed with death penalty experience. They won't be arraigned or asked to enter pleas until that happens.

"At this point, there has been no evidence presented to prove anything," said Keith Higgins, an attorney who represented Aguigui in court Thursday. "The fact that certain statements are being made does not necessarily mean these allegations are true."

Salmon's wife, Heather Salmon, has also been charged with murder and other counts. She did not appear in court Thursday and Durden said he will not seek the death penalty for her.

Authorities took extra precautions Thursday as the accused soldiers, in shackles and jailhouse jumpsuits, were brought before the judge for a preliminary hearing. The defendants were brought to the courthouse one-at-a-time, with their hearings scheduled an hour apart. Deputies armed with assault rifles walked in front of and behind them.

Relatives of both victims have been seething since Monday's hearing after a fourth soldier who says he witnessed both slayings testified about them in detail before pleading guilty to reduced charges. Pfc. Michael Burnett told the judge Roark, whom prosecutors say was helping the militia buy guns, had just left the Army and was considered "a loose end" by Aguigui, the militia's leader.

Burnett said Roark and his girlfriend were led to the woods. Peden shot York before she could get out of her car, Burnett testified, then paused to check her pulse and shot her again. Roark was forced to kneel on the ground before Salmon shot him twice in the head, Burnett said.

Roark's father, Brett Roark, yelled at Salmon from his seat in the courtroom, calling the soldier a "Piece of (expletive)." Then during Peden's turn in the courtroom later, York's stepfather bolted from his third-row seat in the courtroom gallery and rushed toward the suspect at the defense table.

"You (expletive) killed my kid!" Wesley Thomas cried out before at least four deputies and officers wrestled him to the floor and handcuffed him.

Brett Roark stood in his seat and yelled to the deputies: "Get off him!" and "Let him go!" Both men were led from the courtroom, but neither was charged for the outburst.

The Army brought its own murder charges in the case in March, but dropped them earlier this month. Civilian federal prosecutors won't say if they're building a case.

Durden, the state prosecutor, says he doesn't know how many other members belonged to the militia, which prosecutors say was called F.E.A.R. ? Forever Enduring Always Ready. Army authorities have indicated they don't believe the suspects were part of a large group.

"We have one investigation that encompasses all the allegations made against these suspects," said Chris Grey, spokesman for the Army's Criminal Investigations Command. "We're not aware of any other subjects beyond this."

A study by Florida REALTORS? indicates that buyers from outside the country still favor the state when it comes to residential real estate.?

Latin American and Caribbean buyers accounted for 35 percent of all foreign purchases in Florida, followed by Canadians, who represented 31 percent of the buying activity, and Western Europeans, who made up 22 percent of the volume.?

Their favorite markets were Miami and Miami Beach, along with Fort Lauderdale.? Overall, Florida REALTORS? calculated, foreign buyers spent $10.71 billion on homes in the state during the 12 months ended June 30, totaling 19 percent of all residential sales volume there.

Total sales volume from international clients is up nationwide, accounting for nearly 5 percent of all sales in the U.s. During the 12 months ended March 2012, forigen buyers spent an estimated at $82.5 billion, up from $66.4 billion one year prior, according to the National Association of REALTORS?.

Former Fort Collins Resident Indicted for Denial of Service Attack on ...

DENVER?David Joseph Rezendes, aka Joseph David Rezendes, aka Joe Rezendes, age 27, currently of California, was indicted by a federal grand jury on August 21, 2012, on charges related to a denial of service attack he allegedly implemented to retaliate against the Larimer County government, United States Attorney John Walsh and FBI Denver Special Agent in Charge James Yacone announced. He was arrested on August 23, 2012, in Sonora, Texas, following a traffic stop. Today, Rezendes will make his initial appearance in the Northern District of Texas in Abilene. The government is seeking to have him detained and brought back to Colorado by the U.S. Marshals.

According to the indictment and other court records, beginning on Wednesday, September 22, 2010, a debilitating denial of service attack was launched against Larimer County government?s computer network. A denial of service attack makes a computer resource, such as a network or processor, unavailable to its intended users. A common denial of service attack involves a computer or computer network saturating a targeted victim computer system or network, overwhelming that system or network with traffic or communications requests. The attack lasted until September 24, 2010. The denial of service attack affected Larimer County employees? ability to access their e-mail and the Internet, including state computer systems.

The Larimer County Sheriff?s Department and the FBI investigated the attack. As part of their investigation, law enforcement executed a court-authorized search warrant of Rezendes? residence. Computers and computer components were seized during the search. FBI case agents and Larimer County Sheriff?s Department computer forensic experts performed an analysis examining the data on the computers, uncovering evidence that the defendant was in fact responsible for the denial of service attack.

The indictment alleges that Rezendes intentionally damaged a protected computer, possessed unauthorized access devices (credit card information), possessed an identification document-making implement, produced a false identification document, and committed aggravated identity theft.

The indictment includes an asset forfeiture allegation, which states that upon conviction of the violations stated in the indictment, including possessing unauthorized access devices, possessing an identification document-making implement, or providing false identification document, the defendant shall forfeit to the United States any and all of the defendant?s right, title, and interest in all property constituting and derived from any proceeds obtained directly and indirectly as a result of such offense or property used to commit the offense, to include computers and computer components.

?Thanks to the excellent cooperative investigative work of the Larimer County Sheriff?s Office and the FBI, a computer hacker who allegedly shut down Larimer County?s computer system for days has been arrested and will be brought to justice,? said U.S. Attorney John Walsh.

?The FBI strives to collaborate with our local law enforcement partners in a variety of cyber investigations through outreach and our task force environment,? said FBI Denver Special Agent in Charge James Yacone. ?Due to the FBI?s computer intrusion investigations program, the capabilities of all partners are enhanced leveraging everyone?s resources to effectively and efficiently investigate cyber criminals willing to affect our communities? public safety.?

?The computer attack in this case had a significant impact on Larimer County both operationally and financially,? said Larimer County Sheriff Justin Smith. ?We appreciate the FBI and the U.S. Attorney?s Office for assisting us in protecting the taxpayers in Larimer County. Cyber crimes of this nature underscore the importance of cooperation between local and federal officials and the need for their expertise and assistance.?

If convicted, Rezendes faces not more than 10 years? imprisonment and up to a $250,000 fine for one count of intentionally damaging a protected computer and one count of possession of unauthorized access device. He also faces not more than 15 years? imprisonment and up to a $250,000 fine for one count of possession of document-making implement and authentication feature and one count of production of a false identification document. He also face not more than two years? imprisonment consecutive to any other sentence and up to a $250,000 fine for aggravated identity theft.

This case was investigated by the Larimer County Sheriff?s Office and the Federal Bureau of Investigation.

The defendant is being prosecuted by Assistant United States Attorney Ryan Bergsieker.

The charges contained in the indictment are allegations, and the defendant is presumed innocent unless and until proven guilty.

Networks prepare to juggle politics, weather

NEW YORK (AP) ? Television networks are preparing to juggle two major stories in the coming days as Tropical Storm Isaac heads toward New Orleans after side-swiping the site of the GOP national convention in Tampa.

Anderson Cooper of CNN and Shepard Smith of Fox News Channel were shifted Monday by their networks to New Orleans. It's an odd rerun: four years ago Cooper also left a Republican convention to head to the gulf region ahead of Hurricane Gustav.

News networks already had to make programming changes with the Republicans postponing the opening night of their convention on Monday. The strength and timing of the storm will also affect how much time will be spent on each story.

Said one network executive: "Expect to see a lot of split-screens."

Grenade kills policeman, wounds dozens as Kenya riots rage

Angry youths killed a Kenyan policeman and wounded over a dozen others in a grenade attack Tuesday, as riots rocked the city of Mombasa for a second day after the killing of a radical Islamist cleric.

The attack on a police truck came as officers tried to contain protests by hundreds of angry youths who threw stones, damaged cars and chanted slogans in support of slain preacher Aboud Rogo Mohammed.

Foreign embassies -- including those of Australia, Britain and France -- issued travel warnings for Mombasa, a key tourist hub and Kenya's main port.

The cleric -- popularly known as Rogo -- was on US and UN sanctions lists for allegedly supporting Somalia's Al-Qaeda-linked Shebab militants.

He was killed Monday in Mombasa when unidentified gunmen opened fire on his vehicle as he was driving with his wife and children, leaving it riddled with bullets.

Images released by his supporters showed his bloody corpse slumped behind the wheel. His wife and children reportedly survived the attack.

Furious protests erupted after his death, with one person hacked to death, cars torched, businesses attacked and five churches looted or set on fire.

As the rioting stretched into a second day Tuesday, the Shebab called on Kenyan Muslims to "take all necessary measures" to defend their religion.

"Muslims must take the matter into their own hands, stand united against the kuffar (unbelievers) and take all necessary measures to protect their religion, their honour, their property and their lives from the enemies of Islam," the Islamist group said in a statement.

Staff in Mombasa's main hospital reported Tuesday that at least 14 people had been injured in the clashes, while two anti-riot police were also wounded apart from those hit by the grenade attack, police said.

The Supreme Council of Muslims in Kenya condemned the violence, especially the targeting of churches.

"This kind of violence goes against our faith. The protesters shouldn't hide behind Islam or any of its teachings," said the council's secretary general, Adan Wachu. "These are criminals and should be treated as such."

Rogo was the spiritual leader of the Muslim Youth Center (MYC), a group viewed as a close ally of the extremist Shebab.

The Islamist MYC blamed the authorities for what they called a "targeted assassination", but police have dismissed the claim and say they are hunting the killers.

"Our beloved Sheikh Aboud Rogo... was murdered by the (unbelievers) as part of Kenya's policy of extra-judicial killings against prominent Muslim activists," the MYC said Tuesday in a statement.

Police in turn blamed the killing on the Shebab, with police spokesman Charles Owino saying the group had sought "to galvanise support among the youth".

"Rogo's murder was a well-planned attack by members of Al-Shebab to gain sympathisers.... The Shebab have failed to get followers," Owino told AFP.

The preacher was placed on a US sanctions list in July for "engaging in acts that directly or indirectly threaten the peace, security or stability of Somalia", specifically for recruiting and fundraising for the Shebab.

The United Nations Security Council placed a travel ban and asset freeze on him in July, saying he had provided "financial, material, logistical or technical support to Al-Shebab".

Kenyan Prime Minister Raila Odinga on Monday condemned Rogo's "horrific" murder, adding the government was "committed to bringing whoever was responsible to justice".

Rogo had been accused by the UN of using the MYC group as "a pathway for radicalisation and recruitment of principally Swahili-speaking Africans for carrying out violent militant activity in Somalia."

The cleric is also alleged to have introduced Fazul Abdullah Mohammed -- the late head of Al-Qaeda's east Africa cell, shot dead last year in Somalia's war-torn capital Mogadishu -- to at least one of the men who helped him carry out the twin US embassy bombings in 1998.

The bombings in Nairobi and Dar es Salaam killed 224 people.

With Tropical Storm Isaac bearing down on Florida, the soon-to-be Republican presidential nominee scrapped at least the first day of his national convention, mindful of the good politics of putting safety before, well, politics.

Top Romney aides and Republican National Committee officials scrambled late Saturday behind closed doors to shrink a four-day schedule of events into three for a convention that had been set to open with a sweeping indictment of President Barack Obama's economic stewardship. They said they hoped to begin laying out a revised schedule on Sunday, and it wasn't immediately clear what parts of the agenda would stay and what parts would go.

Nor was it clear whether there would be more delays. Romney's team was preparing for more schedule changes in case Isaac makes landfall elsewhere in Florida, requiring assistance from the brigades of police, national guard and emergency workers assigned to the convention.

Weather-related woes were always a risk when Republicans chose to hold their convention in Florida during hurricane season, a decision made well before Romney locked up the nomination.

Enter Isaac.

With forecasters predicting heavy rains and powerful wind, Romney's team huddled to weigh the pros and cons of cutting the convention short as well as worst-case scenarios. Romney ended up betting that losing a day of his party was less costly than going forward with his four-day plans and angering residents of a state he needs to win.

"The safety of those in Isaac's path is of the utmost importance," campaign said in a tweet.

In truth, Romney had little choice but to truncate his convention.

Insisting on a four-day affair could have put delegates' safety at risk, while tying up law enforcement and emergency officials who otherwise would be dispatched to deal with storm fallout. That would have left a black mark on the convention, with potentially lasting political consequences in a critical battleground state. Polls show Romney narrowly trailing Obama in this state, worth a giant cache of 29 Electoral College votes in a race to amass 270 needed for victory.

It didn't appear that the postponement would cost Romney much in political terms, since the television networks had already announced they would not be carrying any of Monday's events live. Because of that, Romney's team already had moved Ann Romney's convention speech ? essentially her debut on the national stage ? to Tuesday to ensure TV viewers would see it.

At most, Romney was losing a night of speeches planned to castigate Obama on his handling of the economy.

"Even though the days will be abbreviated, I absolutely believe we'll be able to get our message out," senior Romney adviser Russ Schriefer, in charge of the convention's planning, said.

This wasn't the first time a GOP convention ran into hurricane-related trouble.

Four years ago, would-be GOP nominee John McCain postponed the start of the convention in St. Paul, Minn., when a Hurricane Gustav threatened Louisiana ? 1,200 miles away.

The sensitivities among politicians to impending natural disasters come in the wake of 2005's devastating Gulf Coast hurricanes Katrina and Rita, and the criticism Republican President George W. Bush faced for his handling of the chaos.

Mindful of the danger of appearing to put politics before safety, Vice President Joe Biden, the Obama campaign's surrogate-in-chief, canceled a campaign swing through Florida on Monday and Tuesday.

And Obama was keeping tabs on the developments from afar, and dispatching the Federal Emergency Management Agency to assist.

The president had no immediate plans to visit. But he might ? as most presidents do ? if the damage is severe. And if he does, Romney would have to weigh whether to proceed with his convention or scrap more parts of it ? and cede the limelight to the man who holds the office he wants.

In Tampa, RNC Chairman Reince Priebus said the decision to start the GOP convention Tuesday was unanimous, although Romney aides said there was some vocal dissent.

Tree River: An image in the bed...1 Samuel 19:16

Baby S is now a toddler, but she will always be the baby of the family. However, we've decided to dub her Goldilocks here on the blog...keep reading and you'll see why. Of course, she has changed the most since my last post. Next month she will be 23 months old. Today she weighs 24 pounds and is 31" tall.?

Here are a few words that I can think of off the top of my head that I know she can speak appropriately on her own: kitchen, hot dog, apple, orange, (ba)nana, grape, rice, corn, milk, cheese, butter, bread, jam, cookie, popsicle, done, yummy, water, shirt, pants, shoes, socks, table, chair, plate, spoon, car, boat, video, doll, baby, mommy, daddy, recognizable & appropriate names for all the siblings, hold me, please, yes, no, bed, light, (out)side, (in)side, help, stop, please, (thank) you, eat it, I don't know, sheep, pig, dog, cat, horse, deer, fox, bird, fish, cow, rabbit, hair, story, Bible, Jesus, Elijah, diaper, underwear, potty chair, poop, and yucky. I know there are probably a lot more, but basically, I think she is right on target for language development.?

In addition to repeating most words, she knows the basic body parts and will point them out when asked. She also knows the basic animal sounds from dogs and cows to lions. I never thought of making a list like this for the older kids, but with G's challenges, I realized that it is hard to remember when the older kids met the milestones, so I'm recording Baby S's here.?

Goldilocks started climbing out of her crib early in the morning on May 31. She used a rocking chair to climb back in later the same morning. That night she slept on her mattress on the floor. Since then, she sleeps pretty well in her own toddler bed, but when we can't find her, we check out all the other beds that Goldilocks might be trying out.?

Sometimes in the middle of the day she naps in M's bed. That pillow can make his bed too soft for Goldilocks.

Sometimes she climbs in bed with a sleeping S.? That lumpy kid can make the bed too hard.

But most of the time she can be found with a sleeping Sacagawea. She thinks Sacagawea's bed is just right.

As you may have noticed in the picture above with S, and more of the photo I posted a few days ago of S's arm...

Goldilocks got an owie on her arm two weeks ago today while we were eating supper.? The Man, who was sitting right beside her, got up to get something from the kitchen.? She stood up in her highchair and I told her to sit down.? Instead she attempted to climb out of her highchair.? Before I could get to her side, she rolled over the edge and hit the floor. [Just a note that she does have an adjustable highchair.? We've since adjusted it down to the floor, which she dislikes because she wants to see everyone while she's eating, but that's just too bad.? Better safe than have another spill!]? Over the next few minutes it was obvious that she had hurt her arm as she refused to use it, but it looked ok, as in no obvious breaks.? The Man decided to splint it with materials we had on hand and just watch and see how she did.? She did fabulous with her foam/cardboard/duct tape/ace bandage splint, and we kept it on her for a few days. Whenever it would slip off of her itty-bitty arm, she would bring it to me ask for "help" getting it back on.?

A few days later she had an x-ray to confirm she "just" had a greenstick fracture like S.? On that day, The Man made her a professional grade splint that expanded Goldilock's clothing options. We will keep it on for at least another few weeks, although she really seems to like it and she may want to keep it longer.? It hasn't slowed her down a bit.

I was going to put a new, clean bandage on before church today, but I was feeling yucky so she and I stayed home. It did give us another day to work on some new toddler skills.? Yes, those are training pants that she is wearing.? She's done reasonably well and I hope she is "done" before our church backpack trip next month!

An iPod Nano Pocket Watch Crowdfunding on Kickstarter is Designed and Not Just Made in China

While the face-kini is the latest strange Chinese phenomenon, there are designs emerging from China that are not strange but instead, stylish. Two such designs, PodKit Watch? + ClipClok?, are iPod nano? watch accessories currently crowdfunding on Kickstarter.

An American-Taiwanese industrial designer, Simon Kwan, is amongst the coming wave of independent designers and smaller brands that want to change Western consumers? perceptions of Chinese design. With the success of Apple? MacBooks?, iPhones?, and iPods?, all made in China, the quality and perception of Chinese made products is already improving. Designed in China, however, is still a novel idea, with very few Chinese brands, such as Lenovo? and Haier?, and even fewer Chinese designers making inroads into Western markets. Kwan, and others like him, is seeking to change that.

Kwan?s PodKit Watch? is a modern retro mix of a classic gentlemen?s pocket watch and personal electronics accessory. Inspired by the success of LunaTik?, the first Kickstarter design project to raise almost $1 million in crowdfunding, Kwan decided to also use the site to launch his own take on the iPod?-as-watch product trend. His design, however, adds some new twists. Unlike the LunaTik?, PodKit Watch? isn?t worn on the wrist. It comes with two chains allowing it to be either worn on clothing and bags or as a pendant.

Indeed, Kwan hopes his design will appeal better to women, who may not wish to wear a nano wristwatch, which is somewhat ironically bulky on the wrist. Kwan?s design also doesn?t require tools to install or remove the nano. As with classic pocket watches, this one has a spring loaded cover that protects the nano?s touchscreen display. Opening the cover also simultaneously wakes up the nano?s display from its power saving sleep mode. Nano wristwatch owners need to press the nano?s power button using their other hand to do the same.

The ClipClok? is an analog watch, or timepiece module as its designer refers to it, that is shaped just like a nano. It?s meant to be swapped in place of the nano when owners either can?t wear the nano as a watch, like on rainy days or when their nanos need recharging, or when the next generation iPod nano? is introduced, most likely featuring a new shape and size.

Kwan launched his Kickstarter project at the beginning of August, and with a little over a week remaining, has not had as much success as he had hoped in reaching his funding goal. Does this signal that the world isn?t ready for Designed in China? Kwan thinks not.

He instead believes his campaign?s slow funding is due to his lack of PR and marketing savvy. Prior to launching his campaign, Kwan didn?t even have a Twitter account. He has learned quickly and is now active on Twitter, Pinterest, and Google+. It remains to be seen, however, if his actions now are enough for PodKit Watch? + ClipClok? to succeed.

Regardless of the outcome, Kwan says this, his first attempt at crowdfunding, has been an incredible learning experience, ?My backers, friends, and family have been so supportive. I?ve received enough honest compliments about my designs that I feel confident if I fail this first time out, I can re-structure, re-launch, and succeed in the future. I think there are great designs waiting to come from designers in China, and crowdfunding is a fantastic way to both fund them and validate consumer interest.?

South China Sea conflict generates uncertainty and insecurity

PARIS, France ? A recent article, "China?s South China Sea jurisdictional claims: when politics and law collide," published in the East Asia Forum, remarked that the uncertainty and insecurity generated by China?s claims in the South China Sea are reflected in headlines throughout Southeast Asia, even though the claims have no solid legal basis in international law.

The insecurity is a consequence of tension in the region and in international relations rising from China?s newly aggressive posture in the South China Sea. The claims are based on a so-called ?9-dashed line? map, adapted by the Zhou Enlai government when it took control of China in 1949. It is taken from the original map, known as the ?11-dashed line? that was drawn by Chiang Kai-shek?s nationalist government in 1947, a time when the islands of the South China Sea, once said to be a Japanese lake, were being returned to the countries that had possessed them before World War II.

The fundamental difference in the maps is that the Nationalist China map includes the Gulf of Tonkin, the Communist China map does not. The dashes on the maps refer to the demarcation lines used by China for its claim of the South China Sea area that includes the Paracels Island and the Spratly Islands. China occupies the Paracels, which are closest to China and Vietnam, but Vietnam and Taiwan are claiming them. Claims on some or all of the Spratly Islands, which are nearest Indonesia and the Philippines, are being made by the Philippines, China, Brunei, Malaysia, Taiwan and Vietnam. The Spratlys are believed to contain important mineral resources, including oil.

The confusion over the legality of claims to the territories begins with the San Francisco Peace Treaty, signed in 1951, that officially ended World War II and Japan?s position as an imperial power. Neither China nor Taiwan were present because countries attending the peace conference could not agree which was the legitimate government of China. The treaty, as signed by the parties, did not specify which countries could legally possess the former Japanese territories in the South China Sea.

Taiwan and China each wanted Japan to return the islands of Paracels and Spratlys to them. This resulted in Taiwan?s version, the "11-dashed line" map, and Communist China?s adaptation that became the ?9-dashed line.? The 1952 Treaty of Taipei between Japan and the Republic of China, newly established on the island now known as Taiwan, did not assign possession of Paracels and Spratlys. Communist China unilaterally claimed the right to have the islands.

Thus, the current claims of both China and Taiwan have no basis in international accords and, in effect, are illegal. China is inconsistent in attempting to de-recognize Japan?s World War II territorial claims in the South China Sea while using those claims to assert its sovereignty on former Japanese territories.

Internationally, the political and legal status of Taiwan remains a contentious issue. Consequently, China?s claims to the territories, based on Taiwan?s sovereignty, are among many unresolved issues between the two countries.

Disputes on the sovereignty over the Paracels and Spratlys in the South China Sea existed before the World War II. All unilateral or bilateral agreements or claims on multilateral disputes are invalid.

The United Nations Law of the Sea Convention that concluded in 1982 defines the rights and responsibilities of nations in their use of the world's oceans. Among its provisions are rules for establishing territorial limits and providing means for settling disputes over coastal claims. All of the countries boarding the South China Sea, except North Korea, are among the 162 nations to ratify the treaty. The U.S. Senate has not ratified the treaty.

Under international law, the current crisis should be presented to the Law of the Sea Convention to settle the Chinese challenge to Vietnam, the Philippines and others over claims to more than 40 islands in the South China Sea.

Among the territorial disputes the Law of the Sea Convention might address is to clarify which areas are disputed and which ones are not. In May 2009, for example, Malaysia and Vietnam submitted jointly to the UN Commission on the Limits of the Continental Shelf, which was established to implement the Law of the Sea Convention.

Also in May 2009, China submitted for the first time its ?9-dashed line? map attached to a Note Verbale to Secretary-General of the United Nation seeking to refute the claims of Vietnam and Malaysia and to clarify its claims. Although the claim in China?s map was unclear, its submission was considered a major milestone in the South China Sea disputes.

Because that was the first time the international community knew officially of the Chinese claims designated on the map, Vietnam immediately sent a diplomatic note to the Secretary-General to refute China?s claims. These submissions did not identify clearly the disputed areas, but they are legal and valuable documents for the settlement procedure.

Philippines, a leading voice in the resolution of South China Sea issues, has recently proposed a solution based on a Zone of Peace, Freedom, Friendship and Cooperation. It requires a clear delimitation of disputed and undisputed areas in accordance with the UN Convention on the Law of the Sea before peacefully pursuing joint development as outlined in China?s proposal.

The Philippine proposal segregates the undisputed areas from disputed ones. Vietnam supports the Zone of Peace, Freedom, Friendship and Cooperation while China has rejected it and pressed others Association of South East Asian Nations not to participate in discussions about it.

Not surprisingly, since China has never made clear its claims by using the so-called ?9-dashed line? covering virtually more than 90 percent of the South China Sea, this rule-based concept breaks through the imprecision of China?s approach. China?s assertive posture has raised concerns among the international community about the potential for conflict in the South China Sea area. Beijing?s steps in the South China Sea are more determined and aggressive than ever, creating the worrisome prospect of escalating tension in the area. The first step toward settling these disputes through peaceful negotiations based on international law would be for all to claimants to state their claims with clarity.

Isaac set to hit Haiti; alert issued for south Florida

Those considered most vulnerable were urged to move into an evacuation camp housed in a school building, but others with nowhere else to go were digging trenches to avoid the water. Updated at 5:45 p.m. ET: Tropical Storm Isaac built up strength Friday as it headed towards landfall in Haiti overnight, while a tropical storm watch was issued for the Florida Keys and other parts of southern Florida.

With sustained winds now at 65 mph, up from 50 mph Friday morning, Isaac could pass near Florida's Gulf Coast early Monday just as the Republican National Convention is scheduled to start in Tampa.?

Winds at tropical storm strength extend 185 miles out from Isaac's center, the U.S. National Hurricane Center said in an afternoon advisory, making it a very wide storm.

On exiting Haiti, Isaac's center should cross Cuba on Saturday, and then pass south of the Florida Keys before making landfall as a Category 1 hurricane overnight Tuesday somewhere between New Orleans and Tallahassee, NBC meteorologist Al Roker said Friday on TODAY. Warm waters in the Gulf of Mexico will be "energy for the storm" as it makes its way across the gulf, he added.


In related developments Friday:

  • The U.S. embassy in Haiti sent an e-mail to American citizens in the country warning that flights into and out of Port-au-Prince have been suspended due to Isaac.
  • Oil and gas producers in the Gulf of Mexico started preparing as Isaac's track looked to skirt the heart of the U.S. offshore energy producing zone. BP?said it would shut down its giant Thunder Horse platform, the world's largest. Royal Dutch Shell, Chevron and Apache Corp. said they would evacuate some workers from their Gulf platforms with no production impacts. Other offshore drillers were likely to shut production in coming days as the storm approaches.
  • The U.S. military moved 22 F-16s from?Homestead Air Reserve Base in Florida to Fort Worth, Texas. Three F-15s from the base are on alert to move to Jacksonville if necessary.

South Florida could see a few twisters and heavy rain -- some 5-10 inches Sunday and into Monday, weather.com experts said in an online chat with readers Friday.

Florida has not been hit by a major hurricane since 2005 and officials are concerned that residents there have become complacent.

Aid workers prep Haiti's tent city residents for Isaac's onlsaught

"I think it's a challenge of getting people to understand their risk and make sure they?ve got a plan," said Craig Fugate, administrator of the Federal Emergency Management Agency.

With more than 19 million people living across the Sunshine State, Fugate wants every Florida resident to have enough supplies to last 72 hours and to know when to evacuate.

"I think the most dangerous thing is when people keep waiting to see what the next forecast is even if they?re in an evacuation zone. They say, 'Oh, it?s just a Category 1 storm or a minimum hurricane.' We?ve seen significant impacts from tropical storm force winds and rain," Fugate added.

In the Florida Keys, where there are few routes available for evacuation -- U.S. 1, Key West International Airport, and the Florida Keys Marathon Airport -- Mayor Craig Cates said his biggest concern was the storm's timing. Cates said he would need at least 36 hours to begin evacuations of tourists and residents.

"If it (Isaac) comes straight on to Key West, we?re worried about the damage that could happen in Key West. If it goes further up the Keys, it could damage power lines and we could get affected," Cates said. "Even if it hits further up the state, we have got to be prepared with our generators and our supplies. Being on an island, we understand that."

Forecasters with The Weather Channel think the evacuation decisions could come quickly. It is anticipated that watches will be issued for South Florida and the Keys by Friday night. In the event of an evacuation, Cates told The Weather Channel that tourists would leave first, followed by special needs citizens.?

Florida Gov. Rick Scott said?state officials are working with convention organizers, who will ultimately make the call on a delay or cancellation of the event.

Isaac is forecast to remain a tropical storm after crossing the Dominican Republic and Haiti and then passing over Cuba into the Florida Straits.

Tampa officials have not ruled out the possibility of postponing the GOP Convention if the storm poses a public safety risk. NBC's Kerry Sanders reports.

The National Hurricane Center?warned it was "important not to focus on the exact track because of forecast uncertainties and the fact that Isaac has a large area of tropical storm force winds."

Isaac was expected to dump between 8 and 12 inches of rain over parts of Haiti and the Dominican Republic, and up to 20 inches in a few areas. That poses a significant threat to Haiti, which is highly prone to flooding and mudslides because of its near-total deforestation.

Haiti, the poorest country in the Americas, still has about 350,000 people living in tents or makeshift shelters more than 2-1/2 years after a devastating earthquake that took more than a quarter of a million lives.

With nearly 400,000 people still living in evacuation tents, a hurricane or even a tropical storm could lead to deaths and more damage to the already fragile country. NBC's Mark Potter reports.

Authorities in the Dominican Republic evacuated people living on the banks of rivers, streams and areas vulnerable to landslides in preparation for the approach of Isaac, whose effects were beginning to be felt with showers in the south of the country.

Report: IEA May Tap Oil Reserves as Soon as September

World oil consumers are poised to tap into emergency oil inventories as soon as early September after the International Energy Agency (IEA) dropped its resistance to a U.S.-led plan, a source and an oil journal said on Friday.

The IEA, whose chief dismissed the need for emergency action as recently as a week ago, is now thought to have agreed to the idea, the industry journal Petroleum Economist reported on Friday, citing unnamed sources.

The agency, which advises industrialized countries on energy policy, was worried that key members including the United States, France and Britain might make act together to draw on stockpiles without coordinating with the rest of the group, undermining its credibility, according to the report, which was largely substantiated by an industry source.

"The U.S. is the main driver, the IEA sees no need for a release. However, if major consumers such as the U.S., UK and France want a release, the IEA is likely to step up and play a role," said the source, who spoke on condition of anonymity.

"A release could be as early as September."

News that consumer nations could be moving quickly toward intervening in oil markets again weighed on prices, with benchmark Brent crude falling $1.42 a barrel or 1.2 percent to close at $113.59 a barrel. The impact was muted by oil platform closures as a storm heads toward the U.S. Gulf.

The Petroleum Economist said that the sharp decline in Iran's oil exports this year would be used as a justification.

A release of as much or more than last year's 60 million barrel injection could occur as early as September, the monthly journal reported in an article by editor Derek Brower, who also writes for the Economist magazine.

"Whether it's self-inflicted or not, that's still a supply disruption," the article quoted an unnamed an official at a government backing the release as saying. The Petroleum Economist has been a well-regarded energy industry publication for decades, but it is better known for its sophisticated analysis and detailed maps than for breaking news.

WHITE HOUSE 'DUSTS OFF' PLANS

Talk of tapping into strategic stockpiles resurfaced last week after Reuters reported that the White House has began "dusting off" old plans for a possible release as it fears that the 30 percent rise in oil prices since June could undermine the effect of sanctions on Iran. Analysts also have said the move could be timed to aid President Barack Obama's reelection effort.

The Petroleum Economist said the White House had spent "recent weeks" seeking to persuade other countries to join the plan, although officials in both the United States and other IEA members told Reuters that no talks had been held by last week.

Last Thursday, a source familiar with the matter said U.S. officials were waiting to assess market conditions after the Labor Day holiday on Sept. 3 before making a decision.

Plans do not appear to have reached an operational stage.

"I have received no official instruction telling me to stand ready to release stocks and I'm unaware of such plans," said Jean-Marc Tenneson, head of the steering committee of France's strategic oil reserves agency (CPSSP).

He said a release would not be "reasonable" under current circumstances, and would only be legitimate if, for example, geopolitical tensions between Iran and Israel worsened noticeably.

FRANCE, UK SUPPORT; SAUDI CONSULTED

The Petroleum Economist, part of the Euromoney group, reported that France and Britain, both of which had signaled their support for releasing reserves during an earlier round of discussions in the spring, have endorsed the strategy.

It cited a diplomatic source as saying a British cabinet official had discussed the move in Washington in recent days.

Last Friday, IEA Executive Director Maria van der Hoeven said there was "no reason for a release," and that no other IEA member was considering such a measure. She said then that she had not been in contact with the White House over possible intervention.

The Petroleum Economist article said that the IEA had changed its stands after "lengthy talks with U.S. Department of Energy officials in Washington earlier this month."

The IEA was not immediately available for comment on Friday, but an agency spokesperson had told the journal that the agency "continuously monitors the oil market and remains in close contact with its member countries' governments so that it stands ready to act swiftly if needed and appropriate."

Officials in Japan and South Korea -- both of which have cut back Iranian imports in order to avoid new U.S. sanctions -- also dismissed the need for emergency supplies last week. The Petroleum Economist story said some IEA members were still opposed, including Germany.

U.S. and British officials have consulted on the plan with Saudi Arabia, according to the report. The kingdom believes that there is no need for a release, but that the decision is up to consumer countries, according to the story.

Oil consultancy Petroleum Policy Intelligence (PPI) said this week that some consumer nations had discussed a possible price trigger of $115 to $120 a barrel for taking action, according to the journal's report.

Missouri woes are latest for GOP in Senate quest

(AP) ? It's not just Todd Akin. The fallout from the Missouri Senate candidate's "legitimate rape" comment was the latest signal that the Republican path to the majority in the Senate may have just gotten tougher.

Democratic prospects have improved in states where Republicans had long been favored, like North Dakota and Arizona. And Republicans also now face the possibility of losing a seat in Maine.

The GOP argues that it still has a strong path to power, given improved prospects in states like Wisconsin, Nevada and Connecticut.

On Capitol Hill, Republicans are expected to keep control of the House and need to gain four seats claim the Senate majority? or three if Mitt Romney is elected, making Wisconsin Rep. Paul Ryan the tie-breaking vote.

Which party controls the Senate has vast influence over the future of major policies, such as President Barack Obama's health care law and the tax code, as well as the makeup of the Supreme Court. Four of nine current justices are over the age of 70.

If Republicans win control of the Senate and hang onto the House majority, a second-term Obama would find it difficult to pass any major legislation without great compromise. On the other hand, if Republican Mitt Romney wins and the GOP controls Congress, Romney could have an easy time pushing through his agenda to repeal Obama's health care overhaul and Wall Street regulations.

Multiple factors appeared to be working in Republicans' favor as this campaign cycle began. One-third of the Senate is up for grabs every other year, and this year, Democrats have 21 seats to defend, while Republicans have just 10. A still-sluggish economy, high unemployment and a Democratic president with an approval rating under 50 percent offered the GOP reasons for optimism.

But the Senate terrain now looks less dreary for Democrats.

The latest blow for Republicans came Sunday.

Missouri Sen. Claire McCaskill, widely regarded as the most vulnerable Democrat up for re-election this year, watched her opponent, Rep. Akin, start to implode when he said in an interview that women's bodies can shut down pregnancies in cases of what he called "legitimate rape." Although Akin repeatedly apologized, top Republicans demanded he drop out and vowed to deprive him of funds should he stay in the race, as Akin has vowed to do.

That episode came six months after the surprise retirement announcement from Sen. Olympia Snowe, a popular Republican in left-leaning Maine. It created a major opening for Democrats, who were favored to pick up the seat until Angus King, the state's independent former governor, entered the race. Although King has refused to say which party he will caucus with if he wins the seat, both parties expect him to cast his lot with Democrats, making it a loss for Republicans.

In other states, the GOP shifts in fortune have been more subtle.

Democrats are playing defense in North Dakota, where Sen. Kent Conrad is retiring.

The state's other Senate seat and sole House seat both flipped from Democratic to Republican in 2010, and conservatives have been bullish about GOP Rep. Rick Berg's prospects for completing the clean sweep. But even Republicans acknowledge the race has become more competitive, with the GOP outside group Crossroads spending more than $700,000 on ads hitting Democrat Heidi Heitkamp, a huge amount in a state where advertising is relatively cheap.

Heitkamp, a former state attorney general, has eschewed her party's label by criticizing Obama whenever opportunities present ? on domestic energy, for instance, a hot issue in North Dakota. Berg has relentlessly pinned Heitkamp to Obama and his health care law, both of which are unpopular there and which Heitkamp praised before launching her campaign.

In Arizona, Republican Rep. Jeff Flake was expected to coast to a seat left open by the retiring Sen. Jon Kyl. But real estate mogul Wil Cardon has pummeled Flake on the airwaves, spending $6 million of his own money on mostly negative TV ads.

Flake still is the heavy favorite in Tuesday's primary. But if he wins, he'll enter the general election with just $1.7 million in the bank, slightly less than Democrat Richard Carmona. A former U.S. surgeon general and son of Puerto Rican immigrants, Carmona has Democrats enthused over his perceived appeal to independents and the state's growing Hispanic population.

"There's far too much extreme, vitriolic attacks," Carmona said on Friday, "and I think the public is tired of that."

Republicans have seen their prospects brighten elsewhere in recent months. And they say they're nimble enough to redirect their resources to achieve maximum effect.

"Missouri is clearly a setback if Congressman Akin chooses to remain in the race," said National Republican Senatorial Committee spokesman Brian Walsh. "On the flip side, Republicans still have a number of great opportunities to win back seats in other states across the country."

Wisconsin Republicans have their most viable general-election candidate in former Gov. Tommy Thompson, who edged out three conservatives with closer ties to the tea party in a hard-fought August primary. A CBS-New York Times poll released Thursday showed Thompson 6 points ahead of Rep. Tammy Baldwin, one of the House's most consistent liberals. And GOP enthusiasm may be higher in Wisconsin now that Romney has tapped Ryan, one of the state's congressmen, as his running mate.

To the west, Nevada Rep. Shelley Berkley, the state's Democratic Senate nominee, is under investigation by the House Ethics Committee. For Berkley, it's an inopportune time for the panel to be examining whether she used her position to benefit her family's financial interests. Berkley has said there was no conflict of interest.

Republicans are also eyeing opportunities in Connecticut, where former wrestling executive Linda McMahon is making a second go at a seat after losing in 2010, and in Florida and Virginia. Those two presidential battlegrounds have competitive Senate races likely to be overshadowed by the deluge of spending by Romney and Obama.

We've already seen many companion apps on mobile, but now TV Guide is diving in wholeheartedly with the next generation of its app for iOS devices.
